Street vending cart rules in Berkeley, CA β also called pushcart, food cart, or sidewalk vendor regulations β set where mobile vendors can operate and what permits they need.
Berkeley sidewalk vending carts and stands are regulated under BMC Chapters 9.48 (arts and crafts) and 9.49 (food), as conformed to California SB 946. Carts must fit within the vendor's allocated site, must not obstruct the pedestrian right-of-way, and food carts must additionally hold Alameda County Environmental Health approval.
BMC 9.48 and 9.49 govern the equipment a sidewalk vendor may use. Equipment must be limited to what the vendor can place within the allocated site and must leave the ADA-required clear sidewalk path under BMC 14.48.170. Food carts and pushcarts are also subject to California Retail Food Code (Cal. Health & Safety Code Β§ 113700 et seq.) approval and must display a current health permit issued by Alameda County Environmental Health. Carts must be removed from the public right-of-way at the close of business each day; overnight storage on the sidewalk is not allowed. Vendors are responsible for keeping the surrounding sidewalk clean and removing any trash, oil, or food waste generated during the day. Generators, propane tanks, and other power sources are subject to Berkeley Fire Department rules under the California Fire Code as adopted by BMC Title 19.
Equipment that exceeds the allocated site, obstructs the right-of-way, or operates without a county health permit (for food) is an administrative violation. Citations follow the SB 946 schedule: up to $100 first / $200 second / $500 third offense within one year; failure to maintain a state or local business license carries higher caps ($250 / $500 / $1,000). Repeat violations may lead to permit revocation by the City Manager.
