Liberty Township (Butler County) requires a Zoning Certificate from the Township Zoning Department for any swimming pool, plus a separate building permit issued by the Butler County Department of Building and Zoning. The township charges a $25 zoning certificate fee for pools, fences and sheds, and requires the applicant to take all Liberty Township-approved zoning forms to Butler County for the building permit and final inspection.
Per the Liberty Township Zoning Resolution Section 7.14 (Swimming Pools, Pool Fences, and Pool Covers), every in-ground and above-ground pool requires a Zoning Certificate before installation. The certificate verifies that the pool sits at least 10 feet from any property line and behind the rear of the dwelling, and that it complies with the township's accessory-structure standards (max 3 accessory structures per lot, 6-foot setback from the principal building). Once the Zoning Certificate is issued, the applicant must apply to the Butler County Department of Building and Zoning for the building permit, which incorporates the Ohio Residential Code Appendix G fence and barrier requirements (minimum 4-foot enclosure with self-closing, self-latching gate). A final inspection by Liberty Township Zoning (513-759-7508) is required after construction; commercial pools also require a Butler County Health District plan-review and operating permit under OAC 3701-31.
Operating or constructing a pool without a Zoning Certificate is a violation of Liberty Township Zoning Resolution Section 13.06, punishable by a fine up to $500 per day under ORC 519.99.
