Bay County's tree code is a preservation ordinance, not a replant one, so it sets no mandatory replacement ratio. Instead it minimizes protected-oak removal and can reward tree preservation with reduced parking requirements.
Unlike many Florida jurisdictions, Bay County's Land Development Regulations Section 1911 impose no fixed tree replacement or mitigation ratio when a protected oak is removed. The ordinance instead aims to minimize removal: no permit is granted unless the applicant takes reasonable measures to design and locate improvements so the number of protected trees removed is minimized. As an incentive, the county allows a reduction in required parking spaces on development sites that preserve a protected tree of 12-inch trunk diameter or more, or extra native vegetation. Single-family homeowners are exempt. Replanting native canopy lost to Hurricane Michael is encouraged but not mandated.
Because there is no replacement mandate, there is no replant penalty. Removing a protected oak without the required permit is enforced as a Land Development Regulations violation. Single-family lots are exempt.
