Virginia is one of the most restrictive states for municipal impact fees. Va. Code Β§15.2-2317 through Β§15.2-2329 (Road Impact Fees Act) authorizes road impact fees only for high-growth localities meeting specific criteria, and Va. Code Β§15.2-2298 through Β§15.2-2303.4 (Cash Proffer System) authorizes voluntary cash proffers only in connection with rezoning β not on as-of-right ADU permits. Virginia Beach generally does not charge cash proffers on individual ADU additions to existing residential parcels. Project costs are limited to: (1) Permits and Inspections building permit fees per the City Fee Schedule (typically $0.50-1.00 per sq ft for residential); (2) Public Utilities Department water/sewer connection fees if a new connection is needed; (3) Hampton Roads Sanitation District (HRSD) Facility Charges β HRSD is the regional wastewater utility, and ADUs are typically charged 0.5 ERU at approximately $4,200 per ERU (2024 rates), payable at building permit; (4) Stormwater fees per Code Ch. 30; (5) Stormwater quality and quantity requirements for any new impervious surface over 2,500 sq ft (Chesapeake Bay Preservation Act, Va. Code Β§62.1-44.15:67 et seq., applies). Property taxes will be reassessed by the City Real Estate Assessor.
Building without permits avoids upfront fees but exposes the project to Permits and Inspections stop-work orders, double permit fees on after-the-fact applications under City Code, and HRSD enforcement for unpaid Facility Charges. Stormwater violations under Chesapeake Bay Act can be substantial.
