Jersey City's Chapter 345 ADU standards do not impose an explicit zoning owner-occupancy requirement on long-term ADU rentals. However, the city's Short-Term Rental Ordinance (Code Ch. 255) requires the property owner to apply for and hold any STR permit, and tenant-applied STRs and rental arbitrage are prohibited. ADU and primary dwelling must remain under common ownership; the lot cannot be subdivided.
Jersey City's Code Chapter 345 ADU provisions establish a one-ADU-per-lot rule and require ADUs to be detached from the principal structure, but the zoning standards do not contain an explicit owner-occupancy mandate for long-term ADU rentals - both the principal dwelling and the ADU may be leased long-term to non-owner tenants in most circumstances. STR permits in non-owner-occupied properties are subject to a 60-day-per-year cap, while owner-occupied STRs are not capped. The ADU and principal dwelling must remain under common ownership; the lot cannot be subdivided to convey them separately. Co-op and condominium master deeds frequently restrict subleasing and short-term rentals; these private restrictions are enforceable in NJ Superior Court. HOA covenants in private subdivisions add additional independent restrictions.
Long-term rental of an ADU is not itself a violation. STR violations under Ch. 255 are enforced by the Division of Housing Preservation with civil penalties typically $1,000-$2,000 per offense and permit revocation. Subdivision of the lot to convey the ADU separately would violate Ch. 345 and trigger Map Act enforcement. Co-op/condo and HOA violations are private civil matters.
