Unincorporated Sutter County has no carport-specific ordinance. Carports and covered patios are treated as residential accessory structures under Zoning Code Section 1500-10-030: a 3-ft interior side/rear setback applies if under 15 ft tall and more than 70 ft from the front-yard street, increasing to 6 ft within 70 ft, with rear-yard coverage capped at 50% (max 1,000 sq ft).
Sutter County does not maintain a dedicated carport ordinance for the unincorporated area. A carport is a roofed, open accessory structure and is regulated under the residential accessory structure standards of Zoning Code Section 1500-10-030, which expressly lists shade structures and covered patios among accessory structures. A carport not exceeding 15 feet in height and located more than 70 feet from the street corresponding to the designated front yard must maintain at least a 3-foot setback from any interior side or rear property line; if located less than 70 feet from that street, the minimum setback is 6 feet. A carport over 15 feet in height must meet the same setbacks as a primary structure in the base zoning district. When a carport is located within a required rear yard, it counts toward the 50-percent rear-yard coverage limit (capped at 1,000 square feet total). Front-yard and street-facing placement is governed by the base zone's front setback. A building permit through the county Building Division is generally required for a permanently constructed carport, and the structure must maintain the required separation from other buildings on the lot. These accessory-structure standards were adopted June 28, 2022.
Erecting a carport that encroaches into a required setback, exceeds the rear-yard coverage limit, or is built without a required building permit can trigger code enforcement and orders to relocate, modify, or remove the structure.
