Tijeras Comprehensive Zoning Ordinance treats carports as accessory structures. Per the Article VI use table, accessory structures of 450 sq. ft. or smaller without utilities are permissive (P) in residential zones; larger or utility-served structures are designated (D) and need clerk review under Sec. 26-67. Buildings cannot exceed 26 feet in height (Sec. 26-654), and Bernalillo County issues the building permit under Sec. 26-69.
Tijeras does not have a stand-alone carport ordinance. A carport is treated as an accessory structure under Sec. 26-9 ('subordinate and incidental to a principal use or structure on the same lot') and is governed by the Article VI table of allowable uses. Per that table, an 'accessory structure 450 sq. ft. or smaller without utilities' is permissive (P) in Residential Zone 1 and Residential Zone 2, while an 'accessory structure larger than 450 sq. ft. and/or with utilities' is designated (D) and requires clerk review. Sec. 26-67 requires every new structure to be reviewed and approved by the clerk, planning and zoning commission, or village council before erection. Setbacks follow the underlying zone: R-1 is 20 ft front / 15 ft rear / 10 ft side (Sec. 26-390); R-2 is 30/20/15 (Sec. 26-414). Sec. 26-654 caps building height at 26 feet. Once village approval is granted, Sec. 26-69 requires the owner to obtain the actual building permit through Bernalillo County Planning and Development Services and return the inspections and certificate of occupancy to the village.
Erecting a carport without prior village review and clerk approval violates Sec. 26-67. Building outside zone setbacks, exceeding 26 feet of height (Sec. 26-654), or failing to obtain the Bernalillo County building permit and final inspection under Sec. 26-69 are independent violations enforced through Sec. 26-37 and penalties under Sec. 26-6.
