Albany County, NY Accessory Structures: Shed Rules (2026)

Under 19 NYCRR Part 1203 (NYS Uniform Code) and Residential Code of NYS R105.2, one-story detached accessory structures used as tool or storage sheds not exceeding 144 sq ft (gross floor area) are exempt from building permit but must still comply with zoning setbacks and property line rules. Larger sheds need a town building permit (typically $50 to $150 depending on municipality) with plans showing lot dimensions, setbacks, and foundation type. Town of Bethlehem Code Chapter 128 requires 5 ft rear/side setback for residential sheds; Town of Colonie Code Chapter 190 requires 10 ft from any dwelling and 5 ft from lot line; Town of Guilderland Code Chapter 280 requires 5 ft side/rear and that sheds not occupy more than 30% of rear yard area. City of Albany Zoning Code 375 limits accessory structures to 15 ft height in residential zones and prohibits them in front yards. All sheds must meet floodplain rules in NFIP SFHA zones (Hudson River and Normans Kill corridors). Sheds over 200 sq ft may trigger assessment increases at the town assessor level. Prefabricated sheds delivered by box store installers still require permit if over 144 sq ft.
