New York does not have a statewide tiny-home statute. A tiny home on a permanent foundation is treated as a single-family dwelling and must comply with the NY Residential Code (2020 IRC with NY amendments): at least one habitable room of 70 sq ft, ceiling height of 7 ft minimum (6 ft 8 in sloped), egress windows, smoke/CO detectors, and full mechanical systems. Appendix Q (Tiny Houses 400 sq ft or less) has been adopted in New York allowing reduced loft stairway dimensions and emergency escape through lofts. Tiny homes on wheels (THOWs) are classified as either RVs (if ANSI A119.5 certified) or park trailers. Most Rensselaer County towns permit RVs in campgrounds only; living in a THOW as a permanent residence in residential zones is prohibited. Short-term use (under 30-60 days) on private property is allowed in some rural towns.
Occupying an unpermitted THOW as permanent residence: $100-$500 per day under Town Law 268 or city code, plus order to vacate. Building without permit: double the permit fee as penalty plus stop-work order. Health Department violation if no septic/water approval.
