The Town of Stony Point regulates livestock and poultry through Town Code Chapter 215 (Zoning), with farm and agricultural uses generally limited to the Town's larger-lot residential and agricultural districts. Backyard chickens are not allowed by right in most platted single-family neighborhoods; lot size, accessory-use, and nuisance provisions in Chapter 215 control where poultry may be kept.
Stony Point's Chapter 215 Zoning Code, adopted 8-3-1985 and amended periodically, sets the rules for what land uses are allowed in each district. Agricultural uses including the raising of poultry, fowl, and small livestock are typically permitted in the larger-lot residential districts (such as R-80 and lower-density rural zones) where lot sizes and rural character allow it, often subject to setback requirements for coops and runs and to nuisance provisions in the Town Code. In the more densely platted residential districts (R-12, R-15, R-22 and similar), chickens and roosters are not listed as a permitted accessory use and are generally not allowed. Rockland County zoning is layered with state Agriculture and Markets Law Β§301-Β§308 (Right to Farm) for parcels in a certified Agricultural District. The Town does not list a separate stand-alone backyard-chicken permit; any owner contemplating chickens should confirm with the Stony Point Building & Zoning Department which zoning district their parcel lies in, the lot size, and whether a special-use permit is required. Common-law nuisance rules apply to noise (especially roosters), odor, and rodent attraction from feed.
Keeping chickens, roosters, or other livestock in a zoning district that does not permit them is a Chapter 215 violation. The Town's Code Enforcement Officer may issue a notice of violation requiring removal of the animals and any structures (coops, runs) within a set cure period. Continued non-compliance can be prosecuted in the Stony Point Justice Court with fines under the Town Code's general penalty provision.
