Construction without a Uniform Construction Code permit is separately enforceable under N.J.A.C. 5:23, with stop-work orders and additional penalties. Continued occupancy of an illegal unit can also affect rental registration and certificate of occupancy status.

Compared to other cities, Mahwah takes a harder line on adu rules. The enforcement and penalty structure reflects that.

Shed Rules

Mahwah Township's zoning code regulates residential sheds by size, with smaller utility sheds allowed close to property lines and larger accessory structures held to stricter setbacks and height limits.

Key details: Small shed setback: 5 feet rear and side. Small shed height: 10 feet maximum. Small shed size: 120 square feet. Large structure cap: 1,000 sq ft, 20 feet. Permit required: Zoning permit before install.

Building without a zoning permit, exceeding size or height caps, or placing a shed inside a required setback can lead to stop-work orders, summonses, and orders to relocate or remove the structure.
