New Jersey Uniform Construction Code permits (N.J.A.C. 5:23) are required for any construction work to create or convert the apartment, including separate egress, smoke and carbon monoxide alarms, and any required electrical, plumbing, or mechanical work.
Creating or maintaining a second dwelling unit without conditional use approval, or that exceeds the 800-square-foot or 30% size cap, the three-occupant limit, or the owner-occupancy requirement, is a violation of Chapter 24 and may be enforced through the zoning officer, including notices of violation, summonses to municipal court, and orders to remove the unauthorized use. Construction without a Uniform Construction Code permit is separately enforceable under N.J.A.C. 5:23, with stop-work orders and additional penalties. Continued occupancy of an illegal unit can also affect rental registration and certificate of occupancy status.
