Chicago ADU Ordinance: permanent program effective April 1, 2026 citywide (with aldermanic opt-in for single-family RS zones). Pilot program active in 5 zones since 2021. Coach houses up to 1,200 sq ft.
Chicago's permanent ADU ordinance took effect April 1, 2026 (City Council vote September 25, 2025). Covers all neighborhoods zoned for small apartment buildings and most business districts. RS single-family zones use an aldermanic 'opt-in' system. Pilot program zones (North, Northwest, South, Southwest, West) remain pre-opted-in. Detached ADU (coach house) max: 1,200 sq ft or 50% of primary dwelling (whichever is less); max height 22 feet; 5-ft side/rear setbacks. Owner-occupancy required in South, West, and Southwest zones for 1β3 unit buildings. South/West/Southwest zones also cap at 2 ADU permits per block/year.
Building an ADU without proper permits violates the zoning and construction codes. Operating an ADU as a short-term rental is prohibited and subject to enforcement under both the ADU and Shared Housing ordinances.
