Pennsylvania repealed the statewide mandate for sprinklers in new one- and two-family dwellings effective January 1, 2011 (Act 1 of 2011). Bethlehem does not impose a local residential sprinkler mandate beyond the state baseline. New townhouses, commercial buildings, and existing buildings undergoing significant renovation are still subject to the sprinkler triggers in the IBC and IFC adopted at Article 1701 (PA UCC) and Article 1501 (2018 IFC). Local amendments at Article 1501 add extra alarm and standpipe requirements.
Pennsylvania's residential sprinkler history is critical context. The 2009 International Residential Code (IRC) Section R313, which would have required sprinklers in all newly constructed one- and two-family dwellings effective January 1, 2011, was repealed retroactively by Pennsylvania Act 1 of 2011 (House Bill 377), signed by Governor Corbett on April 25, 2011. The Pennsylvania Uniform Construction Code at 34 Pa. Code Chapter 403 currently does not require sprinklers in new detached one- and two-family homes. New townhouses (three or more attached single-family dwellings) are still required to be sprinklered under IRC Section R313.2 as adopted through the UCC. Bethlehem's Article 1701 (Pennsylvania Uniform Construction Code) adopts the UCC by reference and adds no local residential sprinkler mandate. Commercial and multifamily sprinklers are governed by IBC Chapter 9 and IFC Section 903 as adopted in Article 1501. Bethlehem layers on extra local requirements through Article 1501 Section 1501.05: Section 1501.05(ee) replaces IFC 903.4.2 to require multiple exterior strobe notification appliances on automatic sprinkler systems where multiple sprinkler risers serve separate areas; Section 1501.05(ff) adds Section 905.3.9 requiring Class I standpipes for any interior portion of a building more than 250 feet from the nearest approved point of fire department access; and Section 1501.05(hh) eliminates the IFC 906.1 exception for portable fire extinguishers in sprinkled Group A, B and E occupancies, requiring extinguishers in all listed occupancies 'without exception.' Plan review and permits go through Bethlehem's Bureau of Code Enforcement at 10 East Church Street.
Installing or modifying a sprinkler system without a UCC permit is a violation of 34 Pa. Code Section 403.42 and Article 1701, enforceable under 35 P.S. Section 7210.903 with fines up to $1,000 per day. Operating a building required to be sprinklered without functional sprinklers is an IFC 109 violation; Section 1501.05(l) sets local penalties at $100 to $1,000 per offense for the first two violations, escalating to $5,000 for the third and subsequent; where life safety is threatened, $500 to $10,000 with up to 90 days in jail. Tampering with a required sprinkler system is also a criminal offense under 18 Pa. C.S.A. Section 3304 (Criminal mischief).
