In the Restricted Residential zone, unincorporated Kootenai County requires a 25-foot front yard, 10-foot side yard (6 feet with an alley), 25-foot rear yard, and 15-foot flanking-street setback. Agricultural and other zones set their own distances.
Setbacks are set per zone in LUDC Chapter 2. In the Restricted Residential zone (8.2.409), all structures must observe: front 25', side 10', side with alley 6', rear 25', flanking street 15'. High Density Residential (8.2.506) uses the same distances. In the Agricultural zone (8.2.108), residential structures use 25'/10'/25' with accessory buildings at 25' front, 10' side, 15' rear, and 'all other allowed structures' at 30'/30'/30'. Fences under eight feet and certain patios/walkways are exempt from setbacks (8.4.1106.C). Setbacks from public roads are measured from the right-of-way edge. Cities within the county set their own setbacks.
Building inside a required setback violates the LUDC (8.8.603.A misdemeanor); the county may withhold permits and seek civil penalties up to $1,000/day, $10,000 max.
