After Ohio voters approved Issue 2 in November 2023 legalizing adult-use cannabis, Cincinnati adopted CMC Chapter 715 to regulate the local placement of dispensaries. The chapter requires buffer distances between an adult-use cannabis retailer and protected sensitive uses, including public and private schools, public parks, libraries, and houses of worship, in addition to the statewide setbacks set by the Ohio Division of Cannabis Control. Distances are measured from property line to property line. Existing medical marijuana dispensaries that converted to dual use receive specific transition treatment. Compliance is checked through the city's planning and zoning review before a certificate of occupancy issues.
