Virginia has not authorized commercial adult-use cannabis delivery. Only registered medical patients can receive deliveries from Cannabis Control Authority licensed pharmaceutical processors under tightly controlled rules.
Virginia law currently allows licensed pharmaceutical processors to deliver medical cannabis products to registered patients statewide under Cannabis Control Authority regulation. Adult-use commercial delivery is not legal because Virginia has not opened the recreational retail market. Adult sharing between Virginians 21 and older without remuneration is permitted in limited quantities, but advertised, paid, or app-based delivery to non-patients violates the Cannabis Control Act. Fairfax County Police enforce against unlicensed delivery operations, and Fairfax zoning would treat any future authorized adult-use delivery hub as a commercial cannabis use requiring special exception approval consistent with the dispensary framework.
Operating unlicensed delivery can result in criminal charges, vehicle and product seizure, civil penalties, and zoning violations against the staging location.
