Jackson County and Mississippi coastal cities permit licensed medical cannabis dispensaries in commercial zones. MS Β§41-137-29 sets 1,000 ft buffers from schools, churches, and daycares. MSDH licensing required. Several cities initially opted out but some have rejoined.
Medical cannabis dispensaries are regulated under the Mississippi Medical Cannabis Act (MS Β§41-137-1 et seq.) administered by the Mississippi Department of Health. MS Β§41-137-29 establishes statewide buffer requirements of 1,000 feet from schools, churches, and licensed childcare facilities, with some local variation permitted. Jackson County unincorporated areas allow dispensaries in commercial (C-1, C-2) and industrial zones. Under MS Β§41-137-33, counties and municipalities had an initial opt-out window expiring May 2022, and some Jackson County cities including Ocean Springs initially opted out but have since revisited. Pascagoula and Gautier currently allow dispensaries. Facilities must maintain MSDH tracking systems, patient verification, surveillance cameras, and secure storage. Operating hours and inventory caps are set by state regulation. Dispensaries serving only Mississippi-registered patients with valid MMJ cards.
Operating without MSDH license: felony charges and immediate closure. Zoning violations (buffer, zone): $500 to $5,000 plus license review. Selling to non-patients: license revocation, $10,000+ fines. Security failures: $1,000 to $10,000.
