El Paso County, CO Cannabis Regulations: Home Cultivation (2026)

Colorado cannabis home cultivation in El Paso County operates under Amendment 64 (CO Constitution Art. XVIII §16) and HB 17-1220. Adults 21+ may grow up to 6 plants per person with no more than 3 flowering at once. Total residence maximum: 12 plants under HB 17-1220, regardless of adult count. Plants must be in a locked, enclosed space not visible from public areas. Odor must not constitute a public nuisance. Home cultivation is for personal use only — sale without a commercial license is a felony under C.R.S. §18-18-406. Colorado Springs follows state rules but the city has historically been cannabis-conservative — recreational dispensaries were prohibited until voters approved Question 300 in November 2022, with retail licensing beginning April 2024. Medical dispensaries have been allowed since 2010. El Paso County unincorporated prohibits all retail cannabis (county commissioners ban).
