Illinois Cannabis Regulation and Tax Act (410 ILCS 705), effective January 1, 2020, legalized recreational cannabis for adults 21 and over but prohibits home cultivation for recreational users — a notable difference from other adult-use states. Only patients registered under the Compassionate Use of Medical Cannabis Program Act (410 ILCS 130) may cultivate up to 5 flowering plants at home, and only at their registered primary residence. Plants must be in an enclosed, locked space not visible from public spaces or adjacent property. Landlords may prohibit cultivation in rental units. Will County and its municipalities (Joliet, Bolingbrook, Plainfield, Romeoville, Frankfort, Lockport, Mokena, New Lenox) follow state law and may not authorize recreational home grows. Unauthorized cultivation of up to 5 plants is a civil penalty ($200 fine under 410 ILCS 705/10-50); 6 to 20 plants is a Class A misdemeanor; over 20 plants escalates to felony charges. Odor mitigation and HVAC filtration are recommended for authorized medical growers.
