New York MRTA (2021) allows adults 21+ to grow up to 3 mature and 3 immature cannabis plants per person (max 6 mature and 6 immature per household) for personal use in Buffalo.
Under the NY Marihuana Regulation and Taxation Act (MRTA, Cannabis Law Β§222), adults age 21 and over may cultivate cannabis at home for personal use. The limits are 3 mature and 3 immature plants per adult, with a household cap of 6 mature and 6 immature plants regardless of how many adults reside there. Plants must be grown where minors cannot access them (locked indoor space or secured outdoor location). Home cultivation became legal for medical patients on October 5, 2021, and for adult-use on the effective date after OCM regulations (now in force). Buffalo has not imposed additional local restrictions beyond MRTA. Landlords may prohibit cultivation in leases. Smoking cannabis is allowed wherever tobacco smoking is allowed but is prohibited in motor vehicles, schools, workplaces, and NY State parks.
Exceeding plant count: civil violation or misdemeanor depending on amount. Visible/accessible to minors: additional penalty.
