All cultivation must occur in a fully enclosed, locked space (garage, spare room, shed, or outdoor enclosed structure with solid walls/roof). Plants may not be visible from public property or from a neighboring property (no visible outdoor plants on balconies, open yards, or from sidewalks). Grow rooms must meet electrical code and ventilation requirements; odor that creates a nuisance violates DRMC Β§36 and Β§24. Landlords can prohibit cultivation in rental agreements and often do. HOAs can restrict under CC&Rs. Commercial-scale cultivation (growing for sale) requires a licensed Denver cannabis retail/cultivation facility and is prohibited in residential zones.
