Home cultivation of cannabis is legal for adults 21+ under the NY Marihuana Regulation and Taxation Act (MRTA, 2021), codified at Cannabis Law Β§222. Each adult may grow up to 3 mature and 3 immature plants at their primary residence; maximum 6 mature and 6 immature per household regardless of adult count. Plants must be kept in a location not visible from a public place and must be secured to prevent access by anyone under 21. Home cultivation is technically contingent on the Office of Cannabis Management (OCM) publishing final home-grow regulations; medical patients gained home-grow rights in late 2022 and adult-use home-grow regulations were finalized in 2023-2024. Municipalities could opt out only of retail dispensaries and on-site consumption lounges under Cannabis Law Β§131; they cannot ban home cultivation. Broome County and its major municipalities (Binghamton, Vestal, Union) did not opt out broadly. Landlords may prohibit cultivation and smoking in lease terms under Cannabis Law Β§131(5).
