Article XVIII Section 16 of the Colorado Constitution and CRS 18-18-406 allow adults 21 and older to cultivate up to six marijuana plants for personal use, with no more than three flowering at one time. CRS 25-1.5-110 caps total plants per residential property at twelve regardless of occupancy, except for licensed medical patients with recommendations. Plants must be grown in an enclosed, locked space and may not be visible from a public place. Sale or distribution of homegrown product is prohibited.
Exceeding plant limits can constitute felony cultivation under CRS 18-18-406, with penalties scaling by quantity, plus civil forfeiture of equipment and product.
