Recreational and personal home cultivation of cannabis is prohibited in Florida. Only Medical Marijuana Treatment Centers (MMTCs) licensed by the Office of Medical Marijuana Use may cultivate cannabis under Fla. Stat. 381.986. Qualified patients may not grow plants at home.
Fla. Stat. 381.986 (the Florida Medical Marijuana Act) establishes the only legal cannabis framework in Florida. Patients qualifying under the act receive marijuana from licensed MMTCs only - home cultivation is not permitted under any circumstances. Recreational adult-use cannabis remains illegal in Florida; possession of 20 grams or less is a 1st-degree misdemeanor under Fla. Stat. 893.13. Indiantown does not regulate cannabis use within the home but cannot authorize what state law prohibits. Public use of cannabis remains illegal even for medical patients under Fla. Stat. 381.986(1)(j).
Cultivation of cannabis is a 3rd-degree felony under Fla. Stat. 893.13 (up to 5 years in prison and $5,000 fine). Possession of more than 20 grams is also a felony. Federal law (21 USC 841) prohibits cultivation regardless of state law.
