Ohio Issue 2 (November 2023) legalized recreational cannabis for adults 21-plus, including home cultivation of up to 6 plants per individual or 12 per household under ORC 3780.29. Franklin County follows state law. Plants must be grown in a secure, enclosed area not visible from public spaces.
Issue 2 passed with 57 percent voter approval in November 2023 and took effect December 7, 2023. ORC 3780.29 allows adults 21 and older to cultivate up to 6 cannabis plants per adult, maximum 12 per residence regardless of number of adults. Cultivation must be in a locked, enclosed space not accessible to anyone under 21. Plants cannot be visible from public view including by binoculars or drone. Home-grown cannabis cannot be sold. Possession limits: 2.5 ounces of flower, 15 grams of extract. Public consumption prohibited. Landlords and HOAs may restrict cultivation in rental or association property. The Ohio Division of Cannabis Control regulates licensed dispensaries; adult-use sales began August 2024. Ohio Medical Marijuana Control Program continues for patients.
