Montgomery County, MD Cannabis Regulations: Home Cultivation (2026)

The Maryland Cannabis Reform Act (Chapter 254, 2023 Laws of Maryland), implementing the voter-approved Question 4 constitutional amendment, legalized recreational cannabis for adults 21 and older effective July 1, 2023. Under Criminal Law Article 5-101.1, adults may cultivate up to 2 cannabis plants per household (not per person) for personal use. Plants must be grown in an enclosed, locked area that is not accessible to persons under 21 and is not visible from a public place without the use of binoculars, aircraft, or other optical aids. The grow area must be within the persons primary residence. Landlords and HOAs may prohibit cultivation in rental units or restrict it in common-interest communities through lease terms or covenants. Montgomery County has not enacted any local ordinance adding restrictions to the state home cultivation law. The county follows state law exclusively on personal cultivation limits. Growing more than 2 plants but fewer than a commercial quantity is a civil violation under state law. Commercial cultivation requires a license from the Maryland Cannabis Administration (MCA). Medical cannabis patients registered with the MCA may also grow up to 2 plants under the same household limit.
