The Maryland Cannabis Reform Act, signed into law in May 2023 following voter approval of Question 4 in November 2022, legalized recreational cannabis for adults 21 and older effective July 1, 2023. Home cultivation is permitted with a limit of 2 plants per person and no more than 4 plants per household. However, state law also specifies that no more than 2 cannabis plants may be cultivated per residence regardless of the number of adults. Plants must be grown at the cultivator's primary residence in a locked space that prevents access by anyone under 21 years of age. Plants must not be visible from any public place. Growing cannabis outdoors is technically permitted if the locked-space and visibility requirements are met, but this effectively limits most cultivation to indoor settings. The City of Rockville has not adopted additional local restrictions on home cannabis cultivation beyond state law. Possession limits for adults are up to 1.5 ounces of usable cannabis or up to 12 grams of concentrated cannabis. Medical cannabis patients registered with the Maryland Cannabis Administration may have higher possession limits. Growing more than 2 plants per person or 4 per household is a civil offense with fines up to $750. Cultivating cannabis accessible to minors carries additional penalties. Growing for distribution without a license is a criminal offense. Possession over 1.5 ounces but under 2.5 ounces is a civil violation with a fine up to $250.
