Under Maryland law effective October 1, 2023, new single-family detached houses, duplexes, and townhouses with a garage, carport, or driveway must include either an installed electric vehicle supply equipment (EVSE) parking space capable of Level 2 charging or an EV-ready parking space with electrical panel capacity and a fully installed minimum 40-ampere, 208/240-volt dedicated circuit. EV charging spaces count toward total minimum parking space requirements under zoning and parking laws. EV spaces must display signage indicating the space is reserved for EV charging, any time restrictions, and the maximum violation fine. Homeowner associations and condominium associations are prohibited from banning or unreasonably restricting EV charger installation in an owner's designated parking space. Associations must treat EV charger requests the same as other architectural modifications. An electrical permit from the City of Rockville is required for any new circuit installation for a home charging station. The city issues its own permits independently from Montgomery County DPS.
Installing EV charging equipment without an electrical permit is a building code violation enforced by the Rockville Permits and Inspections Division. HOA restrictions that unreasonably block EV charger installation violate Maryland state law.
