Multnomah County, OR Cannabis Regulations: Home Cultivation (2026)

Oregon's Measure 91 (2014) legalized recreational cannabis and allows adults 21 and older to grow up to 4 plants per household - not per adult - for personal use. The 4-plant household limit applies statewide under ORS 475C.305, and cities/counties cannot raise or lower it for personal cultivation. Multnomah County has not adopted additional local restrictions beyond state law. Portland City Code 14B.70 requires home grows to be in a private, enclosed space not visible from public property, public rights-of-way, or adjacent properties - meaning plants in a front yard are prohibited, but a fenced back yard or indoor grow is compliant. Landlords may prohibit cultivation in rental leases (and most do). Smoking cannabis is prohibited in public places under ORS 475C.301 (Class B violation, $250). Commercial cultivation requires an OLCC (Oregon Liquor and Cannabis Commission) license regardless of size - growing more than 4 plants or any cultivation for sale without OLCC license is a Class C felony (up to 5 years, $125,000). HOAs can restrict or ban home cultivation in common-interest communities. Medical marijuana cardholders may grow more plants per OMMP rules (up to 6 mature plants for one patient at a residential site).
