Adult-use home cultivation of cannabis in Oregon was legalized by Measure 91 (2014) and is now codified at ORS 475C.301 (limits on home production) and ORS 475C.305 (exemption of homegrown plants from licensing). The household limit is 4 mature cannabis plants per dwelling unit total -- not per adult. A household with one adult and a household with five adults are both capped at 4 mature plants. Adults 21 and older may also possess up to 8 ounces of usable cannabis at the home (ORS 475C.305(1)(b)) and process up to 16 ounces of homemade cannabinoid edibles or 72 ounces of homemade cannabinoid liquids. Plants and grow operations must be 'in plain sight only from within the residence' -- visibility from a public place without optical aids (binoculars, drones, etc.) is prohibited (ORS 475C.305(1)(a)(B)). Sales of homegrown cannabis to anyone are forbidden; transfers are limited to 1 ounce of usable cannabis at no remuneration. Tenants should note that landlords retain the right to prohibit cannabis use and cultivation in lease terms (Oregon Fair Housing Council guidance). Federal subsidized housing (Section 8, public housing) prohibits cannabis under federal law regardless of state legalization. Portland has not enacted any additional home-cultivation ordinance; the city defers entirely to state law.
Cultivating more than 4 mature plants per household violates ORS 475C.301 and is unlawful manufacture under ORS 475C.349 -- a Class B felony for more than 8 plants. Visibility from a public place violates ORS 475C.305(1)(a)(B) and may result in a Class B violation (up to $1,000). Sale of homegrown cannabis is a Class B felony under ORS 475C.345. Tenants who grow in violation of lease terms may face eviction under ORS 90.392 (cause for termination).
