Virginia law lets adults 21 and older grow cannabis at home. A household may keep up to four plants under Va. Code section 4.1-1101, each tagged, kept out of public view, and secured from anyone under 21.
Home cultivation is legal in Norfolk under state law. Va. Code section 4.1-1101 allows a person 21 or older to grow up to four marijuana plants for personal use at their residence, and caps the whole household at four plants no matter how many adults live there. Each plant must carry a legible tag with the grower's name, driver's license or ID number, and a note that it is grown for personal use. No plant may be visible from a public way without optical aids, and the grower must prevent access by anyone under 21. Growing for sale, or exceeding four plants, falls outside the personal-use protection, and a landlord may still bar cultivation in a lease.
A first offense of more than four plants, or growing not for personal use, starts as a civil penalty and escalates to misdemeanor or felony charges for larger grows. Selling homegrown cannabis without a state license is a crime.
