Nevada voters approved recreational cannabis through Question 2 in November 2016, codified as NRS 453D. The law legalized adult possession of up to 1 ounce of flower or 1/8 ounce of concentrate for adults 21 and older and created a licensed retail market beginning July 1, 2017. However, the home cultivation provision has a critical limitation: NRS 453D.110 permits growing up to 6 cannabis plants per adult (maximum 12 per household, regardless of number of adults) ONLY when the residence is located more than 25 miles from the nearest operating licensed dispensary. This 25-mile rule was designed to funnel most cannabis demand into the licensed retail market. Reno has numerous licensed dispensaries (The Apothecary Shoppe, Blum, The Source, Jade Cannabis, and others) distributed across the city, meaning essentially all Reno residential addresses fall within 25 miles of at least one dispensary. Practical effect: home cultivation is not legal for Reno residents. Cultivation where prohibited is a misdemeanor for small amounts and felony for larger operations. Medical cannabis patients with a valid Nevada medical card have somewhat broader cultivation rights but still face restrictions. Plants (if legally grown) must be kept in an enclosed, locked space inaccessible to minors and not visible from a public place. Landlords may prohibit cannabis use and cultivation on rental property, and federal housing (Section 8) prohibits cannabis entirely.
