Home cannabis cultivation is PROHIBITED in New Jersey under state law, making it illegal throughout Hudson County. Unlike many recreational-legal states, NJ's 2021 Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act (N.J.S.A. 24:6I-31 et seq.) did NOT legalize home grow. Only licensed commercial cultivators may grow cannabis.
Hudson County residents cannot legally grow cannabis at home despite New Jersey's recreational cannabis legalization. Under the Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act (CREAMMA) signed February 2021 β N.J.S.A. 24:6I-31 et seq. β personal use (up to 6 ounces) and purchase from licensed dispensaries were legalized for adults 21+, but home cultivation was explicitly NOT legalized. Unauthorized home grow remains a criminal offense under N.J.S.A. 2C:35-5 with penalties depending on number of plants: 1-10 plants a third-degree crime (3-5 years, up to $25,000 fine); 10-50 plants second-degree (5-10 years, up to $150,000); over 50 plants first-degree. The NJ Cannabis Regulatory Commission (CRC) licenses commercial cultivators exclusively. Medical cannabis patients registered under the NJ Medicinal Cannabis Program may not grow at home either β unique among medical-legal states. Legislative proposals to allow limited home cultivation (typically 6 plants per household) have been introduced repeatedly in Trenton but have not passed as of 2025. Jersey City, Hoboken, Bayonne, and other Hudson municipalities follow state law β no home grow is permitted. Landlords in Hudson's rental-heavy market routinely include no-grow lease clauses.
