New Jersey legalized recreational cannabis for adults 21+ through the Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act (CREAMMA) in 2021. However, home cultivation of cannabis remains illegal in New Jersey. Only licensed businesses may grow cannabis. Possession for personal use is legal but growing plants is prohibited.
New Jersey legalized recreational cannabis for adults 21 and over through CREAMMA (N.J.S.A. 24:6I-31 et seq., 2021), but the law did not authorize home cultivation. Growing even a single plant remains a criminal offense under N.J.S.A. 2C:35-5, and that applies in Jersey City the same as everywhere else in the state. Medical cannabis patients cannot grow their own either β all legal cannabis must come from state-licensed dispensaries, several of which operate in Jersey City. Bills to allow home grow have been introduced in Trenton but none has passed. Landlords may separately bar cannabis possession or use on their property.
Home cultivation of any amount is a crime under N.J.S.A. 2C:35-5. Fewer than 5 plants: fourth-degree crime, up to 18 months and $10,000. Five or more plants: third-degree crime, 3-5 years, up to $25,000.
