NY Marijuana Regulation and Taxation Act (MRTA, 2021) added Cannabis Law §222, allowing adults 21+ to cultivate up to 3 mature and 3 immature cannabis plants per person, with a household maximum of 6 mature and 6 immature plants. Plants must be grown in the grower's private residence on property owned or leased with landlord permission, secured from public view, and reasonably protected from access by anyone under 21. NY state preemption prevents Rensselaer County, Troy, and county towns from banning home cultivation. Home grow became fully lawful for adults on a date set by the Office of Cannabis Management (OCM) — effective 2025 for recreational under current regulations. Medical cannabis patients have been able to grow since 2022.
