BBQ & Propane Rules: Albany vs Colonie

How do bbq & propane rules rules compare between Albany, NY and Colonie, NY?

Albany and Colonie have similar restriction levels.

Albany, NY

Albany County

Some Restrictions

Albany does not have a dedicated municipal cooking-fire ordinance. BBQ and propane grill use is regulated by the New York State Uniform Fire Prevention and Building Code (19 NYCRR Part 1219), which adopts the 2020 International Fire Code (IFC) §308. In multi-family Group R-2 occupancies, charcoal grills and open-flame cooking devices are prohibited on combustible balconies or within 10 feet of combustible construction unless the building is sprinklered throughout, and LP-gas containers larger than approximately 1 pound are similarly restricted. One- and two-family detached dwellings are exempt from the multi-family restrictions but must still observe NFPA 58 clearance standards.

Colonie, NY

Albany County

Some Restrictions

New York adopts the International Fire Code as part of the Uniform Code at 19 NYCRR Part 1225 (Fire Code of New York State) under NY Executive Law §378 and is enforced locally by Town code-enforcement officers and the Colonie Fire Marshal's Office. Fire Code §308.1.4 prohibits open-flame cooking devices (including charcoal grills and most propane grills) on combustible balconies or within 10 feet of combustible construction in buildings other than one- and two-family dwellings (i.e., apartments and multi-family). Exceptions allow LP-gas devices with limited cylinder size on sprinklered balconies; electric grills are not restricted. For single-family Colonie homes the IFC restriction does not directly apply, but LP-gas cylinder storage is still governed by NFPA 58 as referenced through the Uniform Code.

Albany FAQ

Can I use a propane grill on my apartment balcony in Albany?

Generally no. New York State Uniform Fire Prevention Code (19 NYCRR 1219 adopting IFC §308) prohibits charcoal and other open-flame cooking devices on combustible balconies of Group R-2 multi-family buildings, and restricts LP-gas containers larger than 2.5 pounds water capacity (which excludes standard 20-pound BBQ tanks). The only exception is buildings protected throughout by an automatic sprinkler system. Even where state code allows, most Albany apartment leases prohibit balcony grilling independently. One- and two-family detached homes are exempt from the balcony restriction.

Where can I grill at my Albany house?

At a detached single-family or two-family home, place the grill outdoors at least 10 feet from any combustible construction (siding, deck railings, overhangs, fences) per manufacturer specifications and NFPA 58. Keep spare LP-gas cylinders outdoors and away from heat sources. Never grill in a garage or under a covered porch with limited ventilation due to carbon monoxide risk. Recreational fire pits (non-cooking) must be at least 25 feet from any structure, no more than 3 feet diameter and 2 feet high, attended at all times, with a garden hose or extinguisher nearby (IFC §307).

Colonie FAQ

Can I grill on my Colonie apartment balcony?

Generally no for propane or charcoal grills under Fire Code §308.1.4 as adopted by New York through 19 NYCRR Part 1225, which prohibits open-flame cooking devices on combustible balconies in multi-family buildings or within 10 feet of combustible construction. Limited exceptions exist for fully sprinklered buildings with small (≤1-pound) LP-gas containers. Electric grills are not restricted. Check your lease and contact the Colonie Fire Marshal if unsure.

Can I grill in my Colonie single-family yard?

Yes. Fire Code §308.1.4 does not apply to one- and two-family dwellings (Group R-3 occupancies), so propane and charcoal grills are permitted on patios, decks, and yards in single-family Colonie homes. Standard precautions apply: store propane cylinders outdoors per NFPA 58, do not grill inside a garage or other enclosed space, and respect neighbor smoke-nuisance complaints under any Town nuisance provisions.
