Can I run a business out of my Apex home?

Yes. Apex UDO Sec. 4.5.5 permits home occupations in every residential zoning district subject to performance standards. You must obtain a Home Occupation Permit ($50) from the Apex Planning Department before starting. The business must be incidental and secondary to your residential use, occupy no more than 25 percent of your home or 500 sq ft (whichever is less), be conducted by an immediate family resident, employ no more than one non-resident, post no on-property signs other than a 12 in. x 12 in. placard at the front door, store no business vehicles other than one passenger-vehicle-sized vehicle, and produce no detectable off-premises noise, odor, vibration, smoke, or glare.

Does North Carolina preempt Apex's home business rules?

No. Unlike Florida (HB 403, 2021) or Arizona (HB 2333, 2017), North Carolina has not enacted a Home-Based Business Protection Act preempting local home-occupation regulation. Bills modeled on the Goldwater Institute template (HB 409 and HB 401) were introduced in the 2024 NC General Assembly but did not become law. Apex's UDO Sec. 4.5.5 standards therefore control. Cottage food sales are separately addressed by the NC Department of Agriculture & Consumer Services Home Processor program.

Can I run a dog grooming business from my garage?

Grooming with 4 or fewer clients per day and no overnight boarding can qualify. Boarding or kennel operations are prohibited as home occupations in all residential districts.
