No. Minneapolis repealed the owner-occupancy requirement in 2019 (Ordinance 2019-Or-085). Property owners may rent both the principal dwelling and the ADU to non-owner tenants without losing the ADU's legal status under Chapter 535.
Can I rent both units to non-owners?
Yes. Both the principal dwelling and the ADU may be rented to non-owner tenants. Each rental unit, however, must have a current Minneapolis Rental License under Code Chapter 244, with periodic inspections required.
Does the 2023 court ruling on the 2040 Plan affect owner-occupancy?
No. The Hennepin County District Court ruling and subsequent 2024 Minnesota Court of Appeals decision and legislative response (MN 2024 Ch. 124) addressed the 2040 Plan generally but did not reinstate owner-occupancy. The 2019 repeal remains in effect.
