Gates must be self-closing and self-latching, with latches at least 54 inches above grade. The barrier must prevent a 4-inch sphere from passing through, and pool covers alone do not substitute for a barrier.

Does an above-ground pool need a fence?

Yes if it holds more than 24 in of water. The walls of the pool itself can serve as the barrier if at least 48 in high, but any ladder or steps must be removable, lockable, or surrounded by a compliant barrier.

Do I need an alarm on the back door?

If a wall of the dwelling serves as part of the pool barrier, NCRC AG105.2(9) requires either an alarm on the door, a self-closing/self-latching door, or another approved means.

Is a hot tub or spa exempt?

A spa with a locking safety cover meeting ASTM F1346 is exempt from the 48-in barrier rule under NCRC AG105.4.
