Under Sutter County Code Section 470-020, county parks and recreation facilities are open to the public from sunrise to sunset unless specific posted hours apply, and no one may remain in a closed facility. Use of county parks in unincorporated Sutter County is governed by Chapter 470 of the County Code, 'Regulations for Use of County Parks and Recreation Facilities.' Section 470-020 ('Hours of Use') provides that, except as otherwise established, County parks and recreational facilities are open to the public from sunrise to sunset; where specific hours have been set for a park area, those posted hours must be observed. Use outside normal operating hours may be authorized only by a permit issued by the Director at sole discretion. Overnight camping is allowed only where separately authorized (Section 470-128), and County boat launch facilities are open to the public at all times of day except when closed for high-water events or maintenance. The Director may close facilities or areas for high water, maintenance, or other health, safety, or security reasons, and Section 470-020(e) makes it unlawful for any person to enter or remain in a closed or prohibited facility or area when it is posted with hours or closure information or when so informed by the Director. A 'Park or Recreation Facility' is defined broadly to include county-owned parks, campgrounds, boat launch ramps, and museum grounds (Section 470-005). The Development Services Director enforces non-penal provisions and the Sheriff enforces penal provisions (Section 470-140). These rules derive from County ordinances including Ord. 1585 (2013).
Remaining in a county park or recreation facility after sunset (or outside posted hours) or entering a closed/posted area violates Section 470-020. Under Section 470-150, violations are infractions: up to $500 for a first offense, up to $750 for a second, and up to $1,000 (and/or up to six months in county jail) for subsequent offenses, which may be charged as an infraction or misdemeanor. The Director or Sheriff may also order a violator to vacate and may bar future use for up to 30 days.
