Ohio Revised Code Β§4111.13, enacted via SB 5 in 2016, expressly preempts cities from setting a minimum wage higher than the state rate. Columbus must follow Ohio's $10.45 per hour 2024 floor and cannot legislate a city wage.
ORC Β§4111.13 prohibits any political subdivision from establishing minimum wage rates different from the statewide rate set under Ohio Constitution Article II Β§34a and ORC Β§4111.02. Ohio's minimum wage is indexed annually to CPI; the 2024 rate is $10.45 per hour for non-tipped workers at employers grossing more than $385,000 annually, and $5.25 plus tips for tipped workers. SB 5 (2016) added the express preemption to block Cleveland's then-pending $15 ballot measure. Columbus has no separate city wage floor and cannot adopt one without state legislative change. Federal contractors and prevailing wage rules operate independently.
Wage-and-hour violations expose employers to back pay, liquidated damages equal to twice unpaid wages under ORC Β§4111.10, and attorney fees in private suits or Ohio Department of Commerce enforcement actions.
