Nevada's minimum wage is fixed in the state constitution at $12 per hour after Question 2 (November 2022) eliminated the two-tier health-insurance offset. NRS 608.250 preempts Las Vegas and Clark County from setting any higher local minimum.
Nevada voters passed Question 2 in November 2022, amending Article 15, Section 16 of the state constitution to set a single minimum wage of $12 per hour effective July 1, 2024, eliminating the prior dual-tier system that allowed lower wages when employers offered qualifying health insurance. The constitutional rate is now indexed in statute and may rise further only by legislative action or another ballot. NRS 608.250 explicitly preempts local governments from setting different minimum wages, blocking any Las Vegas or Clark County living-wage ordinance. The Nevada Labor Commissioner enforces wage-and-hour rules, with private right of action for unpaid wages plus liquidated damages.
Paying below $12 per hour violates the Nevada Constitution. The Labor Commissioner can order back wages, liquidated damages equal to unpaid amount, and civil penalties; workers can sue directly under NRS 608.140.
