Suffolk County erosion control is governed by NY SPDES SWPPP requirements, Coastal Erosion Hazard Area Act (NY ECL Article 34), and town Chapter 84 (Brookhaven) and similar. Bluff, dune, and beach construction requires NYSDEC Tidal Wetlands and CEHA permits.
NY ECL Article 34 (Coastal Erosion Hazard Area Act) protects beaches, bluffs, and dunes along the Atlantic and Long Island Sound coasts. New principal structures are prohibited seaward of the bluff crest or primary dune line. Erosion-protection structures (bulkheads, revetments) require NYSDEC CEHA permits and often cannot be newly constructed. Construction sites over 1 acre require NYSDEC-approved erosion and sediment control plans with silt fence, stabilized construction entrances, and temporary seeding per NY Standards and Specifications for Erosion and Sediment Control. Town code enforcement officers inspect weekly.
NYSDEC CEHA violations $500-$10,000 per violation. SPDES erosion violations up to $37,500 per day. Unauthorized bulkheading can require removal at owner expense.
