Construction, fill, grading, or substantial improvement within a Special Flood Hazard Area without an approved floodplain development permit is a violation of the applicable local flood damage prevention ordinance and Tennessee's NFIP-enabling statutes. Sevier County and its cities can require corrective elevation, removal of unpermitted structures, denial or revocation of certificates of occupancy, and civil penalties under their general code enforcement provisions. Persistent non-compliance also exposes the community to NFIP probation or suspension by FEMA, which would eliminate access to subsidized federal flood insurance for all property owners countywide.
