Section 12-305 requires storm water detention and conveyance on land development that needs a grading permit. The main exemption is small: developments disturbing no more than 10,000 square feet of land area in total.
Detention is also excused where runoff drains directly into a recognized floodplain or a sub-surface drainage course without crossing separately owned land, and where a storm water master plan says detention is unnecessary. Design criteria sit in the Storm Water Management Manual, promulgated by the Director of Streets and adopted by reference under section 12-310. Plans must be prepared by a qualified registered professional under section 12-319. Nobody may modify or obstruct a surface or subsurface drainage course without the Director's written consent, which matters in a city with sinkholes and karst drainage. A certificate of occupancy will not issue without the Director's written compliance certification.
Civil penalties of $50 to $5,000 per day apply. The city may withhold a certificate of occupancy and direct the Gas and Water Department to deny utility service to a noncompliant property.
