Under NYS ECL and 6 NYCRR Part 217, heavy-duty diesel vehicles may not idle more than five consecutive minutes. New York City and several Westchester municipalities extend the rule to passenger vehicles, especially near schools. Westchester County school districts enforce no-idling zones at pickup and drop-off lanes consistent with state law. Exceptions apply for emergency vehicles, passenger comfort during extreme heat or cold for occupied vehicles, and mechanical-PTO operations.
State penalties for heavy-duty idling start around 100 dollars and rise with repeat offenses. Municipal extensions to passenger cars typically carry similar fines, with school-zone idling sometimes drawing higher penalties.
