Sec. 6.30 (FW-01)(A) lists the construction requirements that apply to all fences and walls in unincorporated Clayton County. The fence, including posts, foundations and overhanging elements, must sit completely within the limits of the lot to which it is associated. It may not be placed in a required sight clear zone (Sec. 6.27), in any right-of-way, or in a drainage, utility, sidewalk, landscaping or access easement without the holder's written permission, and it must stay at least two feet back from adjacent rights-of-way. A fence with a finished side must face that side outward, and a permit is required before construction.
A fence built over the property line, into an easement, or into a sight-visibility zone can be ordered relocated or removed by the Zoning Administrator, with citations and fines up to $1,000 (Sec. 1-12).
