When a nonresidential development abuts or faces a residential district, Collier County requires the nonresidential owner to build a masonry or concrete wall or fence. Contiguous walls must be 6 to 8 feet tall and set back at least 6 feet from the residential district.
LDC Section 5.03.02 H mandates a buffer wall between residential and nonresidential development. If the nonresidential parcel is contiguous to a residentially zoned district, a masonry, concrete, or pre-fabricated concrete wall and/or fence 6 to 8 feet tall must be built at least 6 feet from the residential district line. If the property is opposite a residential district across a local street or platted alley, height is 4 feet, set back a minimum of 3 feet from the right-of-way landscape buffer. All fences must present a finished side outward and use approved materials. Single-family residential fences are not subject to these buffer-wall standards.
Failure to install a required buffer wall can hold up site development plan approval and certificate of occupancy, and prompt Code Enforcement action under LDC 5.03.02 H.
