Beyond height, Section C.2.040 of the Milpitas Comprehensive Zoning Ordinance sets baseline requirements that apply to fences, walls, and hedges in all zones, including structural supports like pilasters, columns, and posts. Concrete block must be finished with stucco or decorative split-faced block and capped with a decorative cap; plain concrete block is expressly not allowed for walls or fencing. On corner lots, fences within the visibility triangle may not exceed three feet in height unless approved by the Public Works Director. The visibility triangle is defined by lines extended from the face of the curb (or, where no curb exists, the edge of the roadway) to their intersection, with the connecting line measured 35 feet from that point of intersection. All fences, walls, and hedges must be constructed, installed, and maintained so they do not constitute a hazard to traffic, persons, or property. Certain fences required by the Building Code (such as required pool barriers or railings) are allowed to exceed the otherwise-applicable height limits. One entry gateway, trellis, or other entry structure up to 10 feet is allowed in a required front or street side setback, provided it has no solid obstruction over two feet in diameter between three and 10 feet of height. Fences may not encroach into public utility or other easements without written approval from the Public Works Director and the affected utility companies or agencies.
